What is the GPSR and when did it take effect?
The General Product Safety Regulation (EU) 2023/988 has been in force since 13 December 2024. It replaces the old Directive 2001/95/EC and requires online retailers to display manufacturer information directly in product listings.
Which products fall under the GPSR?
All physical consumer products sold in the EU — e.g. clothing, electronics, furniture, toys, household goods, jewellery. Exempt are pharmaceuticals, food, living organisms, vehicles, and antiques, among others.
What information must I display in my online shop?
For every product: the manufacturer's name/brand, postal address, and email address or website. If the manufacturer is based outside the EU, you must also provide the details of the EU Authorised Representative.
What is the "responsible person" under the GPSR?
An economic operator based in the EU who assumes certain obligations of the manufacturer. This is usually the importer or an authorised representative appointed by the manufacturer. Only required when the manufacturer has no establishment in the EU.
Does the GPSR apply to used products?
Yes, the GPSR generally applies to used products as well. Only products clearly marked as in need of repair are exempt.
Am I a manufacturer if I sell products under my own brand?
Yes. Anyone who markets products under their own name or brand is considered a manufacturer under the GPSR — with all the associated obligations.
What happens if I don't comply with the GPSR?
Non-compliance can result in warnings, fines, and a ban on selling the product. Marketplaces like Amazon may remove listings if required information is missing.
Do I need to provide information in multiple languages?
Warnings and safety information must be provided in the official languages of the target countries. For manufacturer details (name, address), there is no translation requirement.
